Agreement
These terms govern use of this website and services provided by Emberglow Marketing LLC, an Ohio limited liability company operating as Emberglow Marketing. Engaging Emberglow for a project constitutes acceptance of these terms, as supplemented by any written project agreement.
Services and scope
Services are delivered according to the package selected and the scope confirmed in writing. Page counts, revision batches, and asset creation support are defined by that package. Work beyond the agreed scope may require a separate scope and fee.
Turnaround
Emberglow targets a 72-hour turnaround once the required information, assets, content, account access, and approvals have been received. This is a target, not a guarantee. Client response times, revision requests, domain changes, and third-party account issues can affect the final launch date.
Client responsibilities
Clients agree to complete the project intake, provide available brand materials and content, maintain domain and third-party account access, supply consolidated revision feedback, and respond to approvals promptly. Delays in these items extend project timelines.
Payment
Package pricing is stated in U.S. dollars. Payment terms, deposits, and final balances are confirmed in the project agreement. Launch and handoff occur after the agreed balance has been paid.
Ownership and accounts
Clients own their content, their domain, and the accounts associated with their website, including their own development platform, registrar, and workspace accounts. Upon final payment, the delivered website is the client's. Emberglow retains no ongoing control over client accounts.
Clients are responsible for the accuracy, legality, and licensing of all materials they provide.
Revisions and maintenance
Revision batches included with each package are described on the Websites page. Ongoing maintenance is not included unless separately agreed. Additional work can be scoped as a new engagement.
Third-party platforms
Websites may depend on third-party platforms for development, hosting, domains, email, and related services. Emberglow is not responsible for outages, pricing changes, or policy changes made by those providers.
Portfolio use
Unless a client requests otherwise in writing, Emberglow Marketing LLC may reference completed work in its portfolio and marketing materials.
Limitation of liability
To the maximum extent permitted by law, Emberglow Marketing LLC's total liability arising from any project is limited to the fees paid for that project. Emberglow is not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
